TERMS AND CONDITIONS
Please read these terms and conditions carefully. When you make a booking with The Ambers at Port Stephens, you accept on behalf of yourself and your party the terms of these booking conditions. It is your responsibility to ensure that all of the details on your confirmation documents are correct and to bring to our attention any errors or discrepancies within 48 hours of your booking.
Guests accept and are held fully responsible for their visitors and children’s actions which may result in injury, harm or death when staying or visiting the property and its surroundings. Any breach of these terms and conditions may result in immediate eviction with no refund or cancellation of your booking.
The agreement is solely with the person or persons the booking name and payment is made in and The Ambers at Ports Stephens (TAPS)
CHECK-IN + CHECK-OUT
Standard check in time is 3pm on the day of arrival and the property is to be vacated by 10am on the day of departure.
An additional fee will be charged if you do not check out by 10am. Early arrivals and late check outs are at the discretion of Management and must be requested at the time of booking and can only be confirmed 1 day prior to arrival or departure. All requests and approvals must be in writing to and from The Ambers at Port Stephens (TAPS) mobile phone or email address, either by text or email. Whilst every effort will be made to accommodate early arrivals and late departures, the only way to absolutely ensure an early check-in or late check-out is to book an extra night.
PET POLICY
We have a strict no pet policy. No pets are permitted on the property at any time. Should pets of any kind be brought to the property, an additional minimum $2,000 cleaning fee will be charged.
STRICTLY NO SMOKING OR VAPING
Smoking on the property both indoors, outdoors and within the grounds of The Ambers at Port Stephens is strictly prohibited. If there is any evidence of smoking inside the property Evidence may be in the form of the smell of cigarette smoke or vape odour, you will be charged an additional $2000 cleaning fee for a specialised clean to eliminate odours and remove chemical residue before future guests may use the space.
SECURITY CAMERAS
The Ambers property has installed several security cameras on the property for monitoring your security. It’s legal for your landlord to install security cameras outside the building door, garage or access gate. This will deter robberies or vandalism from happening.
GATHERINGS, WEDDINGS AND FUNCTIONS
Please contact management for more information. All gatherings are strictly prohibited without written consent from Management prior to your arrival.
Additional fees and terms are applied, and more information will be provided to you upon enquiry. Should guests have gatherings or functions without agreement in written form from management of (TAPS) then a minimum $10,000.00 fee will apply
LIST OF GUESTS ON THE PROPERTY DURING STAYS AND NOMINATION OF VISITOR NAMES/NUMBERS
The Ambers at Port Stephens (TAPS) takes your security and safety very seriously. As such there is a requirement to complete the booking document in its entirety 48 hrs prior to arrival and forward to (TAPS) email. Management will send a reminder email requesting this information. Should in the unlikely event there be an emergency this list will help ensure management can convey the correct information to emergency services, police and the like.
Should you as the primary guest wish to have visitors to the property at any time, it is a requirement of your booking agreement that (TAPS) management be notified of the names of the attending persons and the date and estimated time they will be on the property for management approval. No visitor is permitted to stay/sleep at the property overnight without prior approval from management.
GUESTS RESPONSIBLE FOR THE CONDUCT OF THEIR VISITORS
A guest is responsible for the actions of visitors they invite onto the premises during the occupancy period and must ensure visitors to the premises comply with this agreement as if they were a guest of the premises. Visitor numbers to the property must be approved by (TAPS) management in writing. If evidence of visitors without approval a $10,000 fee may apply
LIABILITY OF (TAPS)
The Ambers at Port Stephens are not responsible for any loss or damage to personal property. Guests are encouraged to secure their belongings and valuables. 8.1. The guests agree to indemnify and hold harmless The Ambers at Port Stephens, its employees, and agents from any claims, damages, loss or liabilities arising from their stay or visitor attendance at the property.
CLEANING AND DAMAGES
On departure, your accommodation is to be left in a clean and tidy state. The Ambers at Port Stephens must be left in the condition it was in upon guests’ arrival.
Extra cleaning charges will apply if this condition is breached and will be deducted from your deposit or credit card. Excess cleaning fees up to $2,000.00 will apply (e.g. rubbish not being removed, dishes not washed and put away, barbecues not cleaned, rubbish left and stains on furniture and carpets/mats).
Please report any existing damage to the property upon your arrival in writing via text and or email and via photo evidence. Please immediately report any damage which occurs during your stay, in writing via text and or email and via photo evidence. Extra cleaning and linen change can be arranged during your stay for an additional charge, at a cost to you. Please contact management for further details. Damages or breakages of furniture or furnishings must be reported to Management immediately. Breakages or damages to the property and all communal or external areas that are caused by any guest and/or a guest’s visitor will be charged and recouped in full of the guest’s credit card or deducted from the guest’s refundable deposit. Excess cleaning required on departure or replacement of items removed from the accommodation will be charged to the guest’s credit card. Furniture, fixtures and fittings are not to be altered or moved between rooms or properties. There will be a charge incurred if furniture is not returned to its original location.
GLASS AROUND POOL AND TENNIS COURT AND POOL SAFETY
Safety around the pool and external areas of the property. Glass bottles or glasses should not be taken into the pool area or onto the tennis court area. Should glass be broken on the property in any location it is to be completely cleaned up to ensure future guests’ safety and comfort. All pool and tennis court equipment must be placed back in the location found and be in a clean and functional state
CHILDREN
We welcome children of all ages to our property. Children’s prices for accommodation are included in the standard tariff rates and refer to children using existing bedding. A complimentary porta-cot can be supplied for children under the age of 2 years. Guests are required to supply linen for this cot and must be set up by guests. Steps, landings and balconies need to be taken into consideration before booking. Please note there are no baby gates or stair barriers, and supervision is the responsibility of parents & guardians. Please contact management if you need further information. No refund will be given if the accommodation is deemed unsuitable after check in. Supervision of children around the pool, fireplaces, stairs, balconies, roads, driveways and all areas of the property and surrounds are the sole responsibility of parents/guardians, and The Ambers at Port Stephens accepts no responsibility.
FIREPLACES AND FIRE PITS
Fireplaces and fire pits are to be operated by adults over the age of 18 only and are operated at your own risk. You will be held liable for any damage you cause including smoke or ember damage from incorrect use. If using a wood or gas fire, you will ensure the fire is switched off or put out entirely before you retire to the bedrooms and whenever you leave the premises even for short periods. Supervision of children around all fireplaces is required and is the full responsibility of parents/guardians. ALL fireplaces and fire pits and their external casings can get very hot and may cause serious burns if touched. It is strongly recommended that the fireplaces not be operated when children are staying onsite.
NOISE
Please ensure all music is turned down by 10pm or as directed by (TAPS) during your stay. Disturbance to other guests and neighbours including excessive noise, music and unruly behaviour is prohibited and may result in eviction without refund. If a noise complaint is received; a first warning will be given. If a second complaint is received this will result in immediate eviction with no refund.
REMOTE CONTROLS FOR TV’S, MUSIC, BLINDS, SKYLIGHTS ETC
The guests are responsible for all remote controls, and these should be kept away from children at all times and or managed by a responsible adult. Should remotes be damaged or lost the cost of replacement will be taken from the deposit or charged to your credit card. Guest must report in writing any issues of loss or damage to management so appropriate action can be taken to replace or repair such items for the next guest’s comfort
LOCKING UP
It is the responsibility of the guests booked in the property at that time to lock the house whenever they leave the property. Any theft that happens due to neglecting to lock the property will result in charges. Keys should be placed I the lock box each time you leave the property, lock box located at the front door.
INDEMNITY
Guests and their visitors’ actions, conduct and safety are the responsibility of the Guests. The Ambers at Port Stephens do not condone unsafe, irresponsible or illegal actions/behaviour etc. on or off the premises, during a stay or at any other time. A condition of entering and/or staying at this property means that all Guests understand and agree to indemnify the agent and owners against any responsibility or action(s) (legal or other), due to any action(s), incident(s), loss or injury(s) while within or outside of the premises (including, but not limited to, the grounds, facilities, structures, etc.) during a stay or at any other time. Your booking request will be confirmed once your payment has been receipted and a receipt emailed to you following your booking confirmation.
SECURITY BOND
Your credit card details will be held on the system as a security bond. Your credit card will be automatically debited in the event of damage to the property, equipment, breakages, theft or if extra cleaning is required. Please note we will only process monies on your credit card if there is reported damage to the Property, or if the 'Terms and Conditions' are not adhered to. If you do not hold a credit card and cannot provide one as a bond, we will require a $5000 cash bond to be paid. This payment will be refunded within 14 days of departure, once we receive your departure inspection report and no charges are required. (Please inform our office via email if you wish to pay the required bond via this method).
The Ambers at Port Stephens is designed to a very high standard, the property is finished and furnished with costly materials and products. You become responsible for all damage and loss to the property and its contents from the date and time you check-in to the date and time you check-out. Any damaged items in the properties will be charged the full advertised replacement cost and product brand, plus an administration cost to obtain these replacements and this cost will be at cost or a minimum additional fee for management of $150.00.
The Property is a residential premise and is strictly for Residential use. The number of occupants allowed is as per approved on your booking email and as advertised. The use of the property for gatherings is STRICTLY PROHIBITED unless written consent has been emailed by management. Use of the property for anything other than as a residential premise will result in the termination of the reservation for the property, removal of the Guests and other occupants from the property without refund as well as other costs or expenses (including an unauthorised function/extra cleaning fee of $10,000).
PAYMENT POLICY
Full payment is required at time of booking to secure your dates. Rates quoted are in Australian dollars and are subject to change at any time. The Ambers is not liable for and is not required to honour any pricing displayed that is quoted in error. Minimum length of stay restrictions apply to certain rates during special event periods and or as nominated in the booking platform (Minimum 3 night stays is a general rule subject to change). Preferred method of payment is Visa, MasterCard, Amex or JCB and surcharges of between 1% and 3% apply for these card transactions, however whatever (TAPS) is charged you as the guest will be on charged.
RESPECTING NEIGHBOURS
A guest must not at any time during the occupancy period:
(a) create noise that because of its level, nature, character, or quality, or the time it is made, is likely to harm, offend, or unreasonably disrupt or interfere with the peace and comfort of neighbours and other occupants of the premises
(b) act in a violent or threatening manner towards neighbours or other occupants of the premises
(c) act in a manner that could reasonably be expected to cause alarm or distress to neighbours and other occupants of the premises
(d) intentionally, recklessly or negligently cause damage to premises, any common property or any other communal facilities within the immediate vicinity of the premises, or any public property in the vicinity of the premises
(f) intentionally, recklessly or negligently damage the personal property of neighbours of the premises.
This section is an offence provision under section 54C of the Act.
The Commissioner may issue guidelines about what may or may not be appropriate conduct under section 2.5.2 of the code.
A guest must not copy, or knowingly retain after the end of the occupancy period, any keys, security passes or other instrument that facilitates access to the premises.

CONFIRMATION OF READING AND UNDERSTANDING THE TERMS AND CONDITIONS
By booking and payment of the nominated booking fees for accommodation at The Ambers at Port Stephens (TAPS), it is agreed by the guest and acknowledged that the guest has read and understood all conditions above. It is further agreed the guest has sought where required their own legal advice if the guest so desired to ensure they are fully aware of the consequences of the conditions and booking of (TAPS) and have made the booking understanding all conditions
